Cloud Backup in Canada: Data Residency, PIPEDA and Choosing the Right Solution

Cloud Backup in Canada: Data Residency, PIPEDA and Choosing the Right Solution

“Where is our data actually stored?” It is a question more Canadian clients, insurers and partners are asking, especially clinics, law firms, accountants and any business holding personal information. When you choose a cloud backup service, the answer matters. This guide explains what Canadian privacy law really says about storing data outside Canada, what to look for in a cloud backup solution, and a simple checklist to choose the right one.

Key takeaways

  • Under PIPEDA, private businesses may use service providers outside Canada, but they stay fully responsible for protecting that data and must be transparent with customers about it (Office of the Privacy Commissioner of Canada).
  • Data stored abroad can be subject to that country’s laws, including access by foreign courts and authorities.
  • Keeping backups in Canadian data centres is the simplest way to reduce that risk and answer client questions with confidence.
  • A real backup is separate from the system it protects, encrypted, and tested.

What Canadian privacy law actually says

Many business owners believe Canadian law requires all data to stay in Canada. For most private businesses, that is not quite right. According to the Office of the Privacy Commissioner’s guidelines on processing personal data across borders:

  • PIPEDA does not prohibit transferring personal information to a provider in another country.
  • You remain accountable for the information and must ensure a comparable level of protection, usually through contracts and by checking the provider’s security.
  • You must be transparent: tell customers their information may be processed outside Canada and may be accessible to foreign courts and authorities.

Some sectors and contracts add stricter requirements, so health, legal and public-sector work often call for Canadian storage. If that applies to you, read our PIPEDA and BC PIPA checklist for clinics and talk to our compliance team.

Check where your Microsoft 365 data lives

Many businesses already use Microsoft 365, and Microsoft operates data centre regions in Canada. You can check where your organization’s core data is stored in the Microsoft 365 admin center under Settings > Org settings > Organization profile > Data location. Remember that Microsoft 365 itself is not a full backup. Our guide Microsoft 365 is not a backup explains the recovery limits.

What a good cloud backup solution includes

  • Canadian storage option with the data location stated in writing.
  • Encryption in transit and at rest, ideally with keys you control.
  • Immutable or offline copies that ransomware cannot delete or encrypt. The Canadian Centre for Cyber Security recommends keeping long-term backups offline and encrypting all backups (Cyber Centre).
  • Coverage of everything that matters: servers, PCs, Microsoft 365 email, OneDrive, SharePoint and Teams.
  • Version history going back months, not days.
  • Regular restore tests with written results.
  • Clear recovery targets: how much data you could lose and how fast you are back up. For bigger risks, see disaster recovery.

10 questions to ask any cloud backup provider

  1. In which country, and which cities, is my backup data stored?
  2. Is any data, including metadata or support access, handled outside Canada?
  3. Is the data encrypted, and who holds the encryption keys?
  4. Can ransomware or a hacked admin account delete my backups?
  5. How often are backups taken, and how long are versions kept?
  6. Do you back up Microsoft 365, or only servers and PCs?
  7. How quickly can a single file, a mailbox or a whole server be restored?
  8. How often are restores tested, and can I see the results?
  9. What happens to my data if I cancel?
  10. Who do I call at 2 a.m. when something goes wrong?

Frequently asked questions

Is it illegal for a Canadian business to store data in the US?

For most private businesses, no. PIPEDA allows it, as long as you protect the information, remain accountable and are transparent with customers. Some sectors, contracts and public bodies have stricter rules.

Is cloud backup safe from ransomware?

Only if it is designed for it. Look for immutable or offline copies and separate credentials, so attackers who reach your network cannot also delete your backups.

How much data history should we keep?

Most small businesses should keep at least 30 to 90 days of daily versions, plus monthly copies for longer if records must be retained.
